It is not expert witnesses, but the police who bring the initial charges. It is not expert witnesses, but lawyers who construct the case against a defendant, who cross-examine witnesses and who make closing addresses to the jury. Although the worst sort of expert witness may prejudice lawyers during initial conference, for the most part experts are but tools in the hands of counsel. It is the lawyers themselves who “shop for opinions” among experts known for their views…. when suspicion of misdeed is raised, it is, of course, necessary that an inquiry is initiated. But, especially in the case of mothers who have lost children, this should be undertaken by senior and experienced detectives in a sensitive manner. It is quite unacceptable for the Crown to prosecute on perceived suspicion alone…
